Dont know any details but I suspect its not a suit for money but rather a suit to prevent Manning from blocking the screening comittee.

This is not about money, but rather he is seeking an injunction that [in essence] will block Mr. Manning from rejecting the candidates of the people's choice. IF he suceeds, that will create an opening for Hart etc.

Valley's move might very well be along the lines of a Gov't for the people, of the people and by the people. If Mr. Manning has his way, it will be a Gov't of Mr. Manning, for Mr. Manning and by Mr. Manning.

An injunction would be an interesting development, but it would not guarantee a Gov't for the people, of the people and by the people.

But it will be a move in the right direction in forcing Mr. Manning to respect and accept the Candidates the people have chosen to represent them in Gov't.

Valley weighing legal options

DIEGO MARTIN Central MP Ken Valley is considering taking legal action against the decision of the PNM Political Leader Prime Minister Patrick Manning and the Screening Committee to reject him as a candidate in the upcoming General Election, sources revealed yesterday.

Sources disclosed that Chairman of the Diego Martin Central Constituency and attorney at law Osbourne Charles wrote the Prime Minister in his capacity as Chairman of the Screening Committee seeking an explanation as to why Valley was rejected.

Legal sources said yesterday that this seemed to be the first step towards judicial review of the PNM’s candidacy selection process. If it is, it would be the first time in the party’s 50-year history that this would happen. The move would coincide with and possibly jeopardise the party’s planned presentation of a full slate of candidates on Saturday at Woodford Square.

Reached for comment, Valley said he was neither confirming nor denying reports that he was exploring legal options.

“I will pursue every avenue. I will test the internal processes of the party and then will go to the country. After all it is for the country to decide,” he stated. Asked whether he met with his attorneys on the issue, Valley replied: “But I never see that! You are asking me all my business.”

Told there were reports that he was contemplating legal action, Valley said: “I can’t influence what people are saying. People are even saying that I had some debt that someone pay off too.” Valley has denied such reports. Pressed further, Valley continued to skirt around the question of whether he would be taking legal action against his party. “Everyday there would be some new talk,” he said. Told that this was sounding like an affirmative response, he said: “I don’t know how it is sounding. I didn’t say yes and I didn’t say no.” Valley said he was under his chairman’s “guidance” “not to talk to the press” and to simply say “let go and let God”.

“One thing I can tell you is that obviously one cannot take legal action without going through the internal processes of the party,” he said.

Those processes are expected to end today when the Central Executive meets to approve candidates, including the candidate for Diego Martin Central. “Let us wait until tomorrow and see what happens,” Valley urged.

A new nominee is expected to be screened for the Diego Martin Central constituency today. Up to yesterday there was no new nomination. But the deadline for nominations is 12 noon today.

What is the point of suing the Prime Minister? They've already picked someone to contest the seat, so it's obviously not love of his constituents.

It can't be about Hart surely, as he was on the self same screening committee that picked Hart's replacement. And also one would think he would be loudly asking people to support Hart.

It can't be about money, because realistically how much will he get.

Just seems to me, that this is about sabotaging the PM and the party by hanging out dirty linen in public?

Fundamentally, I just have a problem with someone who was a poor performer as a MP, and people are screaming to get him back just because the PM was forceful in not wanting them. I mean, c'mon, you saying you want someone not good to represent you? :|




Yeah, I know everyone's gonna come back and say, but he is behaving like an executive president. But is not like the UNC didn't do that, with Bas pushing aside Ramesh/Kamla etc at various times.

but I saw someone say [I think it was The Light on another forum] that Manning's power to override is in the PNM's party guidelines. so how can a court intervene?

and being in the party so long, didn't Ken Valley know this? or does he only care when it works against him.


i get what you are saying. it just doesn't seem fair in a sense that if the people in diego were unhappy with him as mp, and the pm decided to replace him, he should stay because he has allies in the party groups. that doesn't really serve the constituents best does it?

youre right of course. no court can over ride this

the PNM constitution give the Leader absolute power in choosing candidates. its just a nobody (even Wiliams) ever exercised it before.

The difference between Eric and Patrick in this issue was; Eric did not use his veto power but rather gave in to the will of the people. Patrick is basically saying to the people "I don't care what you want as long as I get what I want"
