I just heard the GOTT has lost another case in the Privy Council in regards to the Equal Opportunity Act. Mr. Ramesh Lawrence Maharaj who piloted the Bill in Parliament took the matter to the Privy Council on behalf of the citizens of T&T. GOTT now has 48 hrs to respond to the ruling in which the PC have demanded the Bill be immediately enacted or they will face contempt of court charges.

It was, and RLM appealed it in the PC and won.
Can anyone now say plenty lawsuits?

If a local court deemed it thus then how did the gov't lose? Wouldn't it be the judge who gave the verdict who lost?

ok so a local court deemed it unconstitutional, that decision was challenged by the privy council and overturned..
i am supposing that is what happened. so why bring up that a local court deemed it unconstitutional again? that would have no legal bearing if the Privy council overturned that decision.

The Gov't was the defendant in that case. The judge ruled for the Gov't on their claim it was unconstitutional. RLM appealed the ruling on behalf of the Plaintiff[s].
The Judge was neither the plaintiff nor the defendant, just the referee. the Plaintiffs won and the Defendants [The GOTT]
lost.
Below was taken from the judgement delivered today:
Disposal
37. I would dismiss the appeal. A majority of the Board hold otherwise, and the appeal will accordingly be allowed. Submissions on the form of the order (if this cannot be agreed) and on costs are invited in writing within 28 days. In closing, the Board would respectfully invite consideration by the Trinidad and Tobago authorities of the procedure to be adopted where a duly enacted statute is believed by the government of the day to be unconstitutional. The legislation may in such circumstances be repealed, or a procedure devised to seek the opinion of the court. It is not a desirable practice to leave the statute unimplemented until action is brought against the government by a private complainant seeking an order against the government to implement the statute after a delay of some years.
Check out the tongue lashing by the law lord to the GOTT for not implementing the act sooner. Dictatorship is alive and well.

Well now who likes to act as if Ramesh is the worse thing that can happen to T&T I have to give him credit for this, the man knows his stuff. :lol:

Well just yesterday CM was querying "What Ramesh do for the last 4 years? He ent do nothing, he just coming back for a grab at power".
Apparently he was working to ensure you have equal rights in the land. Something the PNM government was willing to forego.
